Why is worker classification important?

In many jurisdictions it is less costly to both parties to engage with an independent contractor. The hiring party doesn’t need to pay employer’s social contributions, for example, and the independent contractor may benefit from a lower tax rate and the ability to deduct business expenses.

These advantages have of course attracted a certain amount of abuse, known as false self-employment, wherein an individual is classified as an independent contractor despite their clearly dependent relationship with the client.

What are the consequences of false self-employment?

There are two key risk factors with misclassified workers, which are local authorities and the individuals themselves.
Local social and tax authorities are often on the lookout for false self-employment schemes; when they are uncovered there are typically financial and legal repercussions for the individual and the client as the authorities seek to recoup the lost social security contributions and taxes, and to pursue the parties through the local legal system.
Although at first glance false self-employment may appear to benefit both parties, the individual is deprived of several rights that become important later on in the relationship. In many cases the individual is the one who contests their employment status in an attempt to reclaim some of the benefits of employment such as severance, sick pay, and holiday entitlement, among others.

How can I protect myself?

Wherever possible, you should check that each assignment is correctly classified before it starts. In this way you protect your company and the individuals you contract with and get contracts set up correctly from the outset.
